Special counsel asks Supreme Court to review claims of Trump’s immunity

On Monday, Special counsel Jack Smith asked the Supreme Court to quickly review a bid by former President Donald Trump to have the federal election interference charges against him dismissed. Citing its importance to the nation, Smith petitioned the high court to urgently rule on Trump’s argument that he enjoys sweeping immunity against charges he was at the center of a criminal conspiracy to fraudulently overturn his 2020 presidential election loss to Joe Biden.

Smith wrote in seeking an expedited review of the matter, “This case involves issues of exceptional national importance,” noting the former president’s trial is scheduled to begin on March 4. The counsel asked the Supreme Court take up the matter on a “certiorari” basis, urging it to consider the case before it is ruled on by the U.S. Court of Appeals for the District of Columbia Circuit.

Smith said a quick ruling by the Supreme Court is necessary because the case is essentially frozen while a potentially lengthy appeals process is underway. If allowed to do so, the process could push the trial date beyond the 2024 presidential election, in which Trump is the frontrunner to again win the Republican Party nomination.

Trump is facing four counts accusing him of conspiracy to overthrow the 2020 presidential election; his team are trying to have the charges thrown out on broad claims he is shielded from criminal prosecution for official presidential conduct.

15 airmen disciplined by Air Force following investigation of accused leaker Jack Teixeira

According to an Air Force investigation released Monday, fifteen airmen have been disciplined (including with removal of their command) for failing to take proper action when they became aware of accused leaker Jack Teixeira’s activities. The internal review is separate from the Justice Department’s criminal investigation, which led to Teixeira’s indictment earlier this year on six charges of willful retention and transmission of national defense information. Teixeira pleaded not guilty and is awaiting a trial date.

The watchdog report found no evidence that Teixeira’s immediate superiors were aware at the time of his intelligence-seeking activities; however, the report details a pattern of oversight by Air Force officials at Teixiera’s base that indirectly contributed to his ability to gather and then leak classified documents without being caught. The report states that other airmen knew he was improperly accessing the sensitive materials.  According to the Air Force, the 15 service members range in rank from staff sergeant to colonel, and have since been removed from their positions, receiving non-judicial administrative punishments.

Teixeira, an airman 1st class, is accused of spreading highly classified materials through the popular online platform Discord to a small group. Following his arrest in April, the Air Force inspector general was tasked with reviewing the environment around Teixeira and the compliance with policy, procedures and standards by the 102nd Intelligence Wing at Otis Air National Guard Base in Massachusetts where Teixeira was serving as an IT specialist.

Air Force Secretary Frank Kendall said in a statement: “Every Airman … is entrusted with the solemn duty to safeguard our nation’s classified defense information. When there is a breach of that sacred trust, for any reason, we will act in accordance with our laws and policies to hold responsible individuals accountable. Our national security demands leaders at every level protect critical assets, ensuring they do not fall into the hands of those who would do the United States or our allies and partners harm.”

NFL to review Patrick Mahomes, Andy Reid’s criticism of refs after Chiefs’ loss to Bills

The NFL will is said to plan on reviewing Kansas City Chiefs quarterback Patrick Mahomes and coach Andy Reid’s criticism of referees following Sunday’s loss to the Buffalo Bills, with insiders reporting that the league will look at the comments due to there being a “long-standing policy against questioning the integrity of the referees.” On Monday, ESPN’s Adam Schefter said on The Pat McAfee Show that Mahomes and Reid could potentially be facing fines.

After wideout Kadarius Toney was called for an offensive offsides penalty that negated what would have been a go-ahead touchdown for the Chiefs late in the fourth quarter on Sunday, Reid said: “very disappointed that it ended the way it did. Normally I’ll get—I never use any of this as excuses, but normally I get a warning before something like that happens in a big game. (It’s) a bit embarrassing in the National Football League for that to take place…
“I’ve been in the league a long time and I haven’t had one like that. So, not where, at least in that kind of position there where it is not given a heads up to.”

Meanwhile, during Mahomes and Bills quarterback Josh Allen’s postgame meeting on the field, the KC QB said the call was “f–king terrible” and later said to reporters during the postgame press conference: “I’ve played seven years [and] never had offensive offside called. That’s elementary school [stuff] we’re talking about. There was no warning throughout the entire game. Then you wait until there’s a minute left in the game to make a call like that? It’s tough. Lost for words. It’s tough. Regardless if we win or lose, just the end of another game and we’re talking about the refs. It’s just not what we want for the NFL and for football. What you want as a competitor is you practice all week to go out there and try to win, and you want it to be about your team and that team and see what happens. You don’t want to be talking about this stuff after the game. I’m not worried about if there was a flag on the next player or whatever, not a flag. I want to go out there and play and then see what happens at the end, see what the score is, and then I can live with the results.”

Referee Carl Cheffers defended the call after the game, telling reporters: “Ultimately, they are responsible for wherever they line up. No warning is required, especially if they are lined up so far offsides where they’re actually blocking our view of the ball. We would give them a warning if it was anywhere close, but this particular one is beyond a warning.”

Vikings WR Justin Jefferson ‘day-to-day’ after brief hospitalization following chest injury

Minnesota Vikings coach Kevin O’Connell said that wide receiver Justin Jefferson is ‘day-to-day’ after being briefly hospitalized with a chest injury following the Vikings’ 3-0 win over the Las Vegas Raiders on Sunday.  O’Connell said on Monday: “[He’s] day-to-day, hopefully with a good chance of playing with us in Cincinnati.” The Vikings will face the Cincinnati Bengals on Saturday.

After Jefferson caught a 15-yard pass over the middle of the field midway through the second quarter on Sunday in Vegas, he was hit hard by Raiders safety Marcus Epps, and remained down on the field for a bit. After making his way back to the locker room, and the Vikings quickly ruled him out with a chest injury, announcing that he was being transported to the hospital. Jefferson later returned to Allegiant Stadium before the end of the game and traveled home to Minnesota with the team.

The 24-year-old Jefferson had two catches for 27 yards before he was injured; he was playing in his first game back from a long hamstring injury he sustained earlier in the season before being activated off of injured reserve on Nov. 28. In six previous games this season, the wide receiver has 598 yards and three touchdowns.
