Federal judge says DOJ may have violated Luigi Mangione’s right to a fair trial

A federal judge has ruled that the Trump administration and fficials from the Department of Justice may have breached both a criminal procedure rule and an existing court order by issuing public statements that could unfairly prejudice the case against Luigi Mangione, the 27-year-old charged in connection with the murder of UnitedHealthcare CEO Brian Thompson in December 2024.

In a filing on Wednesday, U.S. District Court Judge Margaret Garnett ordered the Justice Department to respond to a letter Mangione’s lawyers sent on Tuesday which accused the Trump administration of violating their client’s right to a fair trial in the wake of Charlie Kirk’s assassination. In the order, she wrote that multiple DOJ staff members appeared to have disregarded a New York rule that bars attorneys from making public remarks likely to bias a criminal proceeding. Mangione’s lawyers referred to several comments administration officials made about Mangione in the days after Kirk’s killing, including by the president.

Mangione’s defense attorney Karen Agnifilo wrote in her letter: “The Government has indelibly prejudiced Mr. Mangione by baselessly linking him to unrelated violent events, and left-wing extremist groups, despite there being no connection or affiliation. A recent, tragic, high-profile murder has only increased this prejudicial rhetoric. The attempts to connect Mr. Mangione with these incidents and paint him as a ‘left wing’ violent extremist are false, prejudicial, and part of a greater political narrative that has no place in any criminal case, especially one where the death penalty is at stake. Mr. Mangione in fact does not support these violent actions, does not condone past or future political violence, nor is he in any way aligned with the group mentioned in the White House press release.”

Mangione’s team presented evidence of statements by DOJ personnel and White House officials that the lawyers argued had tainted their client’s ability to receive a fair trial by tying him to unrelated acts of political violence, including Ryan Routh’s attempt to assassinate former President Donald Trump and the assassination of conservative activist Charlie Kirk.

In response, Judge Margaret Garnett wrote in her decision that “it appears from this letter that multiple employees at the Department of Justice may have violated Local Criminal Rule 23.1, and this Court’s order of April 25, 2025 specifically identifying the strictures of this rule for counsel and directing the prosecution team to ensure that the highest levels of the Department of Justice, up to and including Attorney General Bondi, were aware of and understood they were bound by this Rule,” and clarified that the rule in question provides prosecutors or their employees “not to release or authorize the release of … opinion that a reasonable person would expect to be disseminated by means of public communication, in connection with pending … criminal litigation with which they are associated, if there is a substantial likelihood that the the dissemination will interfere with a fair trial or otherwise prejudice the true administration of justice.”

Judge Garnett has given prosecutors until October 3 to explain how these apparent violations occurred and what measures they plan to take to prevent further incidents. She also warned the deputy attorney general that additional breaches could lead to sanctions, including financial penalties or contempt of court findings.

Guardians’ David Fry suffers facial fractures, broken nose after being hit by pitch

Cleveland Guardians DH David Fry sustained multiple facial injuries, including a broken nose and fractures, after a pitch from Tarik Skubal struck him in the face during the sixth inning of Cleveland’s 5-2 victory over the Detroit Tigers on Tuesday night, tightening the race in the AL Central.

The frightening moment unfolded when Fry attempted to bunt against a 99 mph fastball from Skubal. The ball struck him squarely in the nose and mouth, sending him to the ground clutching his face. Skubal, visibly shaken, tossed his glove and hat aside as Vogt and the training staff rushed to Fry’s aid. Fry remained down for several minutes before teammates and medical staff helped him sit up; he managed to give a thumbs-up gesture before being taken off the field on a cart. The Guardians later announced that he was transferred from Lutheran Medical Center to Cleveland Clinic’s main campus for additional tests and monitoring.

Manager Stephen Vogt said Wednesday morning that he visited Fry in the hospital, where he was listed in stable condition:  “He’s doing all right, he’s in good spirits. He’s alert and sitting up.”  Vogt added: “We’re all thinking about David and his family right now. Obviously, we’re glad he is OK, but obviously it’s a really scary moment.”

Skubal, last year’s AL Cy Young Award winner, had been dominant through the first five innings, allowing just two hits. After the game, he admitted the scene shook him, saying it was “really tough. I’ve already reached out to him. I’m sure his phone is blowing up. I just want to make sure he’s all right. Obviously, he seemed like he was OK coming off the field, and hopefully it stays that way. I know sometimes with those things that can change. So hopefully he’s all right. I look forward to hopefully at some point tonight or [Wednesday] morning getting a text from him and making sure he’s all good because there’s things that are bigger than the game, and the health of him is more important than a baseball game.”

In the aftermath of the incident, Skubal remained rattled; his next pitch to George Valera (who replaced Fry) went wild, allowing a run to score.  He went on to commit a throwing error, and was called for a balk when he attempted an odd behind-the-back toss to first base. Cleveland capitalized and earned three runs in the inning without hitting the ball out of the infield, taking a 3-2 lead that ultimately led to their win.

Fry, an All-Star last season who returned in late May after offseason elbow surgery, has been a key presence in the clubhouse. Guardians left fielder Steven Kwan said the incident regarding his teammate was “definitely really scary. For David to even try something like that [bunt], that’s just who he is. Selfless kind of guy, and especially in a position like that, he’s a tough guy. Thankfully he had some humor when he came up, but you don’t want to see a guy that’s been with you pretty much the whole year [get hurt]. Obviously energy-wise, just who he is as a teammate, he’s meant so much to us as a team. It’s really scary, but thankfully he had some humor coming off the field, so hopefully we get some good news.”

Nationals halt Braves’ 10-game winning streak with 4-3 win

The Washington Nationals defeated the Atlanta Braves 4-3 on Wednesday, to snap Atlanta’s 10-game winning streak.

The Nationals’ James Wood launched two home runs in the sixth and eighth innings (giving him 30 home runs on the year), while Josh Bell added another (his 21st of the season), helping Mitchell Parker (9-16) pick up the win in relief after recording the final two outs of the fifth inning. Parker came in for rookie starter Andrew Alvarez, who delivered 4 1/3 scoreless frames in just his fifth career start. The 26-year-old left-hander has now logged 23 1/3 innings with a 2.31 ERA.

Braves starter Bryce Elder (8-11) took the loss in his final outing of the season, allowing three runs on six hits across seven innings while striking out seven. Atlanta’s Drake Baldwin hit his 19th home run in the sixth inning, a solo shot to left field; and Marcell Ozuna went deep in the eighth. Across the last two games of the series, the teams combined for 10 solo home runs.

The game ended in dramatic fashion in the 9th inning; with two outs, Ronald Acuña Jr. appeared out on an infield grounder, but a replay review overturned the call, keeping Atlanta alive. Moments later, C.B. Bucknor ruled Baldwin safe at first, but another review reversed the decision, sealing the Nationals’ win.

Next up for Atlanta will be their final three-game set of the year at home against the Pirates, with lefty Joey Wentz (5-6, 5.46 ERA) taking the mound Friday.

Washington will square off against Chicago White Sox on Friday, with Nationals’ right-hander Cade Cavalli (3-1, 4.23 ERA) facing Chicago righty Yoendrys Gomez (3-3, 4.92 ERA) in the opener of their three-game series.
